1. About this policy

Bulkit is a marketplace. Products listed on bulkit.uk are sold and dispatched by independent third-party sellers, and your contract for the goods is with the seller, not with us. We coordinate claims with the seller as their agent; we are not the supplier of the goods.

Always contact us before returning anything. Goods sent back without our prior written agreement will be refused and may be returned to you at your cost.

All queries: support@bulkit.uk - please include your order number. We will provide the seller's details on request.

2. Trade buyers only

Every account on bulkit.uk is a business account and every order is placed in the course of a business, for resale or business use. By placing an order you confirm that you are buying in the course of a business and not as a consumer.

Consumer legislation - including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 - does not apply to goods bought in the course of a business. There is no cooling-off period and no consumer cancellation right on this platform.

3. All sales are final

Orders cannot be cancelled or returned because you have changed your mind, ordered the wrong item, ordered too much, or have been unable to sell the stock on.

Faulty, damaged or incorrect goods are dealt with under section 4.

4. Faulty, damaged or incorrect goods

The seller remains bound by the terms implied by sections 13 to 15 of the Sale of Goods Act 1979 - that goods will correspond with their description, be of satisfactory quality and be fit for purpose - excluded only so far as is reasonable under the Unfair Contract Terms Act 1977.

Subject to sections 5 and 6, we will arrange a remedy where goods are damaged in transit, faulty, not as ordered or described, short-shipped, or delivered past their stated expiry date.

We decide which remedy applies - replacement, account credit, or refund - having regard to available stock and the nature of the defect.

Where a breach is so slight that rejecting the goods would be unreasonable, your remedy is a price adjustment rather than rejection (section 15A, Sale of Goods Act 1979).

5. Checking your order

Time is of the essence for notifying us. You must examine your order on delivery and tell us within 48 hours of delivery if anything is damaged, faulty, incorrect or short. Claims made later may be refused.

Email support@bulkit.uk with your order number, photographs of the goods and the outer packaging, and the quantity affected.

Keep the goods and all packaging until the claim is closed - we may arrange collection or inspection.

Hidden faults. Where a defect could not reasonably have been found on inspection, tell us as soon as you discover it and in any event within 30 days of delivery.

6. Returns

Do not send anything back until we confirm the claim in writing.

Where a claim is accepted we will confirm the return address and arrange collection or a prepaid label at no charge to you.

Goods must be returned in the condition supplied, in their original packaging, with seals intact where the item has not been opened.

Where returned goods are found not to be defective, or the defect results from your handling, storage or transport, we may charge carriage and a handling fee, and return the goods to you.

7. Refunds and credits

Where a claim is accepted we will normally issue an account credit.

A refund to the original payment method is available at our discretion and will be processed within 14 days of the claim being agreed, or of the goods being received back where a return is required.

Delivery is included in the price of the goods, so there is no separate delivery charge to refund.

8. Cancelling before dispatch

Sellers dispatch within 24 hours of receiving an order.

If you need to cancel, email us immediately with your order number and we will ask the seller to stop the order.

This is a goodwill step and not a right. Once goods have been dispatched, section 3 applies.

9. Your responsibilities as a reseller

You are responsible for your own regulatory compliance when reselling - including age of sale, storage, labelling, display, advertising and any licensing that applies to your business.

We are not liable for any loss you suffer as a result of your own non-compliance.

10. Liability

Nothing in this policy excludes or limits our liability, or the seller's, for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

Subject to that, and so far as the law allows:

•
neither we nor the seller are liable for loss of profit, loss of business, business interruption, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss;
•
our total liability in connection with any claim under this policy is limited to the price paid for the goods to which the claim relates.
11. Product recalls

If a product is recalled, or found to be unsafe or non-compliant, we will contact affected buyers with instructions.

You must stop selling the affected stock immediately, quarantine it, and cooperate with the recall and with any Trading Standards enquiry.

12. Complaints, governing law and contact

If you are unhappy with how a claim has been handled, email support@bulkit.uk with "Complaint" in the subject line.

We aim to acknowledge within 5 working days.

This policy is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
